License Agreement

1. Grant of License

Subject to the terms of this Agreement, ComusThumbz grants you a limited, non-exclusive, non-transferable license to install and use the ComusThumbz software on a single domain for the purpose of operating a content management website.

This license does not constitute a sale of the software. All rights not expressly granted are reserved by ComusThumbz.

2. License Types

ComusThumbz offers the following license tiers:

You may NOT:

• Redistribute, resell, or sublicense the software to third parties
• Reverse engineer, decompile, or disassemble the software
• Remove or alter any copyright notices or branding
• Use the software on more domains than your license permits
• Share your license key with unauthorized parties
• Create derivative works based on the software for distribution
• Circumvent, disable, or tamper with the license validation system

4. Installation & Domain Binding

Each license key is bound to a single domain at the time of activation. Key details:

• One license key = one domain (e.g., example.com)
• Domain changes require a support request and are limited to 2 per year
• The software periodically validates your license against our servers
• Subdomains (e.g., www.example.com) are considered the same domain
• Development/staging environments must use a separate license or the free tier

5. Updates & Support

Subscription license holders receive:

• All software updates and new features during the subscription period
• Priority technical support via the ticket system
• Access to the community forum and documentation
• Bug fixes and security patches

Free license holders receive access to community support and documentation. Bug fixes are provided at our discretion.

6. Traffic Skim System

The traffic skim system is a core component of the free license model:

• The skim percentage is set by the license server and may be adjusted
• Attempting to disable, circumvent, or modify the skim system is a violation of this agreement
• Subscription license holders are exempt from all traffic skim
• The skim applies only to external outbound links, not internal navigation

7. Termination Conditions

This license may be terminated:

• By you, at any time, by uninstalling the software and deactivating your license
• By ComusThumbz, if you breach any term of this agreement
• Automatically, if subscription payments fail after the grace period
• Automatically, if the license validation system detects tampering

Upon termination, you must cease all use of the software and destroy all copies in your possession.

8. Intellectual Property

The ComusThumbz software, including all source code, object code, interfaces, graphics, documentation, and related materials, is the exclusive property of ComusThumbz and is protected by copyright, trade secret, and other intellectual property laws.

You acknowledge that the software contains proprietary information and agree to maintain its confidentiality.

9. Warranty Disclaimer

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ComusThumbz does not warrant that the software will be error-free, that defects will be corrected, or that the software will meet your specific requirements. You assume all risk associated with the use of the software.

10. Limitation of Liability

IN NO EVENT SHALL COMUSTHUMBZ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

ComusThumbz's total cumulative liability shall not exceed the total amount paid by you for the license in the 12 months preceding the claim.
