Masharti ya Huduma

1. Kukubali Masharti

Kwa kufikia au kutumia programu ya ComusThumbz, tovuti, au huduma, unakubali kuzuiliwa na Masharti haya ya Huduma. Kama hupangi kukubali masharti haya, huwezi kutumia bidhaa au huduma zetu.

Sharti hizi zinatumika kwa watumiaji wote, ikiwa ni pamoja na wageni, watumiaji waliosajiliwa, na wamiliki wa leseni.

2. Usajili wa Akaunti

Kutumia vipengele fulani, lazima uundue akaunti. Unakubali:

• Toa taarifa za usajili sahihi na kamili
• Hifadhi usalama wa credentials za akaunti yako
• Tuarifu mara moja kuhusu ufikiaji wowote usioidhinishwa
• Kubali jukumu la shughuli zote chini ya akaunti yako

Tunahifadhi haki ya kusimamisha au kusitisha akaunti zinazokiuka sharti hizi au kushiriki katika shughuli za udanganyifu.

3. Leseni na Haki za Matumizi

Baada ya kununua au kupata leseni, unapokea haki isiyo ya kipekee, isiyohamishiwa ya kutumia programu ya ComusThumbz kulingana na aina ya leseni iliyochaguliwa:

• Leseni ya Bure: Vipengele kamili na mfumo wa traffic skim unafanya kazi
• Leseni ya Ujisajili: Vipengele kamili, hakuna traffic skim, usaidizi unaendelea

Kila leseni inahusishwa na domain moja. Domains za ziada zinahitaji leseni za ziada. Tazama Makubaliano yetu ya Leseni kwa maelezo kamili.

4. Sera ya Matumizi Yanayokubalika

You agree not to use ComusThumbz to:

• Distribute content involving minors or non-consensual material
• Engage in illegal activities or violate applicable laws
• Distribute malware, viruses, or other harmful code
• Attempt to circumvent license restrictions or the skim system
• Scrape, crawl, or harvest data from other ComusThumbz installations
• Impersonate others or misrepresent your affiliation

Violation of this policy may result in immediate license termination without refund.

5. Payment & Billing

For subscription licenses:

• Payments are charged at the beginning of each billing cycle
• Prices are in USD and subject to change with 30 days notice
• Failed payments may result in license suspension after a grace period
• Multi-license discounts apply automatically based on your active license count
• Refunds are handled on a case-by-case basis within 14 days of purchase

6. Intellectual Property

ComusThumbz software, including all code, design, documentation, and branding, is the intellectual property of ComusThumbz and is protected by copyright and other intellectual property laws.

Your license grants usage rights only. You do not acquire ownership of any intellectual property through your license purchase.

7. User Content & Responsibilities

You are solely responsible for all content hosted on your ComusThumbz installation. You represent and warrant that:

• You have all necessary rights to the content you upload
• Your content does not infringe on third-party intellectual property
• Your content complies with all applicable laws and regulations
• You will respond to valid takedown requests promptly

We are not responsible for user-generated content on your installation and you agree to indemnify us against claims arising from your hosted content.

8. Limitation of Liability

To the maximum extent permitted by law, ComusThumbz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim shall not exceed the amount you paid for your license in the 12 months preceding the claim.

9. Disclaimer of Warranties

ComusThumbz software is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the software will be error-free, uninterrupted, or meet your specific requirements.

10. Termination

We may terminate or suspend your license and account access at any time if you:

• Violate these Terms of Service
• Engage in activities that harm ComusThumbz or other users
• Fail to pay subscription fees after the grace period
• Attempt to circumvent license restrictions

Upon termination, your right to use the software ceases immediately. You may request a copy of your data within 30 days of termination.

11. Governing Law

These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions. Any disputes arising from these terms shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before they take effect.

Your continued use of the software after changes are posted constitutes acceptance of the updated terms.
